WIPO China: How to Use the Global Brand Database to Search for International Trademarks?

全球品牌数据库是WIPO提供的免费在线商标检索系统，汇集了WIPO的自有数据以及缔约国家和地区办公室的数据，通过其可以检索马德里体系下的国际商标、里斯本体系下的原产地名称和地理标志、依《巴黎公约》第六条之三受保护的徽记、世界卫生组织的国际非专利名称，以及缔约国家和地区办公室的商标等6千万余条数据。

Global Brand Database is a free online trademark search system provided by WIPO, which brings together WIPOs own data and that of participating national & regional IP offices, including more than 60 million entries on international trademarks under the Madrid system, appellations of origin and Geographical Indications under the Lisbon system, emblems under 6ter, International Non-proprietary Names (INNs) of the World Health Organization and trademarks from participating national and regional offices.

The trademark data is essential for developing and protecting trademarks. As the first step before filing a trademark application, the Global Brand Database can help to search for similar or identical trademarks that already exist in the target market in order to develop a branding strategy and avoid wasting time and filing costs. In addition, the Global Brand Database allows users to browse existing trademarks in the market of interest. So, how can we use the Global Brand Database to search for international trademarks? This article will focus on five search techniques.

一、通过号码查找商标 Searching By Number

如果你已经掌握你所想查询的商标的号码，全球品牌数据库提供了两种查询方式：

If you already have the numbers of the trademark you would like to search, the Global Brand Database offers two ways to search for a specific trademark:

1. 快速搜索 – 号码 Quick Search – Number

由于快速搜索的号码包含申请号、注册号等所有类型的号码，因此通过快速检索的方式，可能会获得其他不相关的结果。对此，可以使用结果列表左侧的筛选器来限缩检索结果，以找到自己想要查询的商标。

Since the Quick Search includes all types of numbers, such as application numbers and registration numbers, you may get several irrelevant results through the quick search. In this regard, you can limit the search results by using the Filters on the left side of the result list to find the specific trademark that you want to search.

2. 高级搜索 – 号码 – 申请/注册/优先级 Advanced Search – Number – Application/Registration/Priority

使用高级检索，可以选定号码的类型，如申请号、注册号或优先级号。因此如果你已经知道商标号码的类型，高级检索是更佳的选择。

With the Advanced Search, you can select the type of the number, such as application number, registration number or priority number. So if you already know the type of the trademark number that you would like to search, the Advanced Search is a better choice.

二、通过名称查找商标 Searching By Name

如果你有心仪的商标名称，想要检索目标市场中现有的的近似或相同商标，那么全球品牌数据库提供了三种方式来查找相关商标：

If you have a trademark name in mind and would like to search for similar or identical trademarks existing in your target market, the Global Brand Database offers three ways to find relevant trademark:

1. 快速搜索 – 名称 Quick Search – Name

2. 按品牌名称查找 Search By Brand Name

“按品牌名称查找”功能提供4种检索策略，包括：

Search by Brand Name offers 4 search strategies including:

• 嵌入式（结果包含输入的术语）Embedded (results contain entered term)

• 模糊（结果与输入的术语拼写相似）Fuzzy (results are spelled similarly to entered term)

• 发音（匹配的发音与输入词相似）Phonetic (matches sound like entered term)

• 词根化（结果与输入的术语有相同的词干或词根）Stemming (results share the same stem or root like the entered term)

以检索“huawei”为例，嵌入式策略的结果会包含“huawei HCIA”等；模糊策略的结果会包含”huamei”，“huafei”， “wuawei”等；发音策略的结果会包含“huawey”等。检索“electricity”，词根化策略的结果会包含“electric”，“electrical”等。

Searching “huawei” as an example, the results of embedded strategy will contain “huawei HCIA” etc., those of fuzzy strategy contain “huamei”, “huafei”, “wuawei” etc., those of phonetic strategy contain “huawey” etc. And the results of stemming strategy for the search of “electricity” will contain “electric”, “electrical” etc.

Additionally, you can specify your target market by selecting a specific Nice Classification below.

3. 高级检索 – 品牌名称/所有者/代理人 Advanced Search – Brand name/Owner/Representative

三、通过商品和服务分类查询商标 Searching By Classification

如果你对某一市场感兴趣，想要检索该市场中已有的商标，那么你可以通过商品和服务分类查询相关商标。

If you are interested in a particular market and would like to search for existing trademarks in that market, you may find it helpful to search by classification.

1. 按商品和服务分类查询商标Search By Goods And Services

2. 高级检索 – 分类 – 尼斯分类/维也纳分类/美国设计分类 Advanced Search – Classification – Nice classification/ Vienna classification/US designs classification

四、通过品牌标志查找商标Searching By Logo

1. 按品牌标志查找 Search By Brand Logo

“按品牌标志查找”功能利用人工智能商标图形检索技术，能够让潜在近似商标的查找结果更窄、更精确。它提供四种搜索策略，包括概念近似、形状近似、颜色近似和复合近似。

Search by Brand Logo utilizes artificial intelligence-based image search tool, which results in a narrower and more precise group of potentially similar marks. It provides four search strategies, including conceptual similarity, shape similarity, color similarity and composite similarity.

• 概念近似：人工智能确定，匹配近似概念

Conceptual similarity: determined by AI to match similar concepts

• 形状近似：具有相似分布的相似线，忽略颜色

Shape similarity: similar lines with similar distribution – ignores colors

• 颜色近似：颜色近似，分布近似

Color similarity: similar colors with similar distribution

• 复合近似：颜色和边缘信息复合分析

Composite similarity: composite analysis based on color and edge information

2. 查找近似图形Find Similar Logos

除了上传图像查找商标，全球品牌数据库还提供了直接查找现有商标的近似图形的功能。

Except uploading images to find trademarks, the Global Brand Database also provides the possibility to directly find similar logos of existing trademarks.

3. 高级检索Advanced Search

五、组合式检索Searching By Two Or More Criteria

当检索条件为两个及两个以上时，全球品牌数据库提供了筛选器功能和高级搜索以实现组合式检索。

When the search criteria are two or more, the Global Brand Database provides the Filters function and the Advanced Search for combined searches.

1. 筛选器功能 Filters

实例A：特定申请人在某一知识产权局申请的所有商标？

Example A: All trademarks of a specific applicant under a specific IP office?

以雀巢公司为例，在“快速搜索”-“所有人”中输入“Nestlé”即可查询雀巢公司名下的所有商标。

Take Nestlé as an example, enter “Nestlé” in the “Quick Search” – “Owner” to search for all trademarks under Nestlé.

使用检索结果列表左侧的筛选器，不仅可以限定知识产权局，还可以筛选2024年到期的所有商标。

Use the filters on the left side of the search results list to select not only the IP office, but also all the trademarks expiring in 2024.

实例B：特定状态的马德里体系国际商标

Example B: All Madrid trademarks for a special search, with specific status

全球品牌数据库首页的“数据覆盖面”模块不仅展示了当前数据库所收录的数据集，还提供了在特定数据集进行商标查询的可能。

The Data Coverage tab of the Global Brand Database not only shows the current datasets included in the database, but also provides the possibility to search for trademarks in specific datasets.

选择马德里体系数据集进行商标查询，并使用筛选器选择商标状态，即可查找特定状态的马德里体系国际商标。

Search in the WIPO Madrid dataset and use the filters to select the trademark status to find all Madrid trademarks for a special search with specific status.

2. 高级搜索 Advanced Search

在高级搜索中，可以通过“和”（AND）/“要么”（OR）语句组合多种检索条件。

In Advanced Search, multiple search criteria can be combined with AND/OR.
